In doing so, the court expressly overruled several state court decisions that applied a more complicated analysis than federal law, and which appeared to impose a stricter standard of reviewing government regulations impacting private property than under federal law.įor a more detailed summary, see our blog post Yim I and Yim II Clarify Washington Regulatory Takings and Substantive Due Process Law. The Court made clear that the federal analysis for both regulatory takings and substantive due process are to be applied to challenges under both the state and federal constitutions, and that there is no separate test for evaluating state constitutional claims. In Yim I, plaintiffs challenged two new Seattle ordinances impacting a landlord’s ability to select and screen tenants on state constitutional grounds (see also the Yim II decision). The Washington State Supreme Court clarified this question in its Yim I and Yim II decisions. Note that there was significant confusion in Washington State about the appropriate tests to apply to determine whether there was a violation of the state and federal takings or substantive due process provisions with regard to regulations impacting private property. This is a standard that is deferential to local policymakers. Substantive due process basically requires that there be a rational basis, which requires only that a challenged regulation be rationally related to a legitimate state interest. ![]() Both the federal and state constitutions provide due process protections through the Fourteenth Amendment and article 1, section 3 respectively. Substantive Due Process and Regulation of Private PropertyĬourts have also used a "substantive due process" test to analyze the burdens imposed by land use regulations. As long as a regulation allows property to be put to productive economic use, the property has value, and the regulation will not be deemed to deny all reasonable economic use of the property there is no regulatory taking in that situation. In a takings challenge to a regulation, courts generally do not require compensation when the regulation merely decreases property value or prevents property owners from doing exactly what they want with their property. Property owners do not have a constitutional right to the most profitable use of their property. A suit alleging a regulatory taking is also called an "inverse condemnation" action. When adopting regulations, the affected property owner typically initiates a lawsuit to protest the effect of the regulations. When physically appropriating the property the government typically institutes eminent domain proceedings, also called condemnation. By regulating or limiting the use of property under the government's police power authority in such a way as to destroy one or more of the fundamental attributes of ownership (the right to possess, exclude others, and to dispose of property), deny all reasonable economic use of the property, or require the property owner to provide a public benefit rather than addressing some public impact caused by a proposed use.By physically appropriating the property, such as for a right-of-way.A government may "take" property in two basic ways: Just compensation is considered to be the fair market value of the property at the time of the taking. Mahon (1922).īoth the federal and Washington State constitutions provide that the government may not take private property unless it is for a public use and just compensation is paid. Supreme Court first recognized such regulatory takings in 1922. However, both federal and state courts have recognized that government regulation can go "too far" so as to have the same effect on a property owner as if the government had actually physically appropriated the land. They may regulate property for purposes such as abating nuisances, enforcing building and health codes, zoning and planning, and environmental protection. ![]() Pursuant to that authority, a city or county may regulate the use of property. ![]() ![]() Authority to Regulate the Use of PropertyĪrticle 11, section 11 of the Washington State constitution grants cities and counties the police power authority to protect the public health, safety, and welfare.

Night Shift hopes to bring beers from as many as 25 craft-beer-makers to retailers across the state in a new fleet of refrigerated box trucks. Distributors argue the law protects their risky investments in marketing little-known breweries. Brewers want to loosen the restriction, complaining that distributors hoard small brands to keep them from competitors while making little effort to sell them. ![]() Mutual resentment peaked this summer, when lobbyists for the distributors killed several legislative proposals to change the state “franchise” law that effectively binds breweries to their distributor for life after an initial trial period. Wholesalers’ business practices, corporate culture, politics, and overall ethos are distasteful to some small brewers, who profess to believe in quality over profits and a rising-tide-lifts-all-ships approach to competition. “While it’s peculiar to see this announcement being used as a vehicle to attack the very industry they are entering, we are hopeful that one day NSD achieves sufficient growth and success to be considered for membership in this association.” “We expect NSD will experience the challenges of running a multi-brand distribution business effectively, efficiently, and profitably - without giving any unfair preference to the brands from their own brewery - to the detriment of their competitors and new partners,” Kelley said in a statement. This means that, during a state of emergency, the police and other civil agencies may receive additional authority to implement measures such as curfews or travel restrictions. In martial law, military forces step in to fill the roles normally played by civilian authorities, whereas during a state of emergency, the civilian authorities retain primary control but are granted enhanced powers to address the crisis. May involve the temporary suspension of some individual rights or freedomsĪs you can see, while both martial law and a state of emergency involve extraordinary measures during times of crisis, the main differences lie in the type of authority involved and the specific ways in which power is exercised. In these instances, martial law was used to maintain public order, protect national security, and ensure the continuation of government. Historically, martial law has been invoked in the UK during times of crisis or emergency situations such as the Ireland Rebellion in 1916, Second World War, and internal conflict in Northern Ireland. Understanding Martial Law in the UK Legal System This comprehensive guide provides a better understanding of Martial Law and its significance in the legal and political landscape. Congrats go to Opus One for their impressive website with details on all the vintages listed there which is outstanding and most helpful for consumers. Wines were 8 vintages of Opus One ranging from 1982 to 2014 plus a ringer of 2012 Mondavi Reserve. We thought it would be fun and educational to look back at some of these earlier vintages so the Vancouver Group of 8 scheduled a dinner at Blue Water on May 24, 2022.Ī few brief impressions: The bookends both were formidable from Dom Ruinart first 2004 Blanc de Blancs 100% Grand Crus low dosage delicately structured with creamy silky textures finishing up with Dom Ruinart 2007 Rose using B/B with 18% added pinot noir from Ay. Presently winemaker Michael Silacci picks early to maintain freshness maintaining vineyard wild yeasts, using 100% new French oak from 10 coopers aiming for accessibility of the wine on release though best drinking for him around 15 years of age but capable of going 40 years. The resulting wines have improved each decade after trying times early on and are looking at their 43rd vintage in 2022. This also helped vine management (looking for sunlight rather than heat to ripen the grapes), canopy, and pruning of the fruit with closer vines providing some shade themselves against the hot midday sun. The positive result was that denser replanting was key going from rows 12 feet apart with vines every 8 feet to 4 by 4 closer together competing. ![]() However in 1990 phylloxera was discovered in Q Block that resulted in a replanting on St. Another issue was the vines as Mondavi sold a key 35 acre Q block parcel of To-Kalon to the venture plus in 1983-84 they acquired two more vineyards across Highway 29 from Mondavi totalling 138 acres of which 108+ were planted. 1990 was the last vintage made at the Mondavi facility and 1991 the first one in that spectacular new Opus One winery (plagued by water issues built over a geothermal spring with cost overruns). From about 1986 on some Bordeaux vinification methods were being deployed and by the early nineties harmony developed between the Bordeaux & Napa contributions. Initially it was somewhat difficult to reach the unique perfect Opus One style with Bordeaux experts first Lucien Sionneau and in the late eighties Patrick Leon seeking more elegance & finesse while the Mondavi family (Robert, MIchael & Tim with Genevieve Janssens) focusing on the rich bold riper Napa fruit. In the early years the wine was produced at the Mondavi winery and was very California. There were so many aficionados of their wines (Mondavi Reserve Cabernet Sauvignon & Chateau Mouton Rothschild) that the launch of their joint project of Opus One in Oakville California with the inaugural 1979 vintage was met with highly enthusiastic anticipation. Your scribe is a long time follower and admirer of the work of both Robert Mondavi and Baron Philippe De Rothschild. ![]() Having spent a lot of time with gaming laptops, what XMG offers software-wise almost seems spartan but its that way because that is what end users have asked for. ![]() ![]() You spend top dollar on one of these XMG laptops, and its not just about the hardware specifications that command this premium XMG provides these options without a lot of the software "bloat" that you'll find elsewhere. XMG is really ready to offer customers full control over the hardware they have purchased, and the appearance of these options in the BIOS speak volumes towards that focus. We've gone from none to several pages of options to adjust, with both power limits and voltage settings adjustable by the end user. Undervolting options for the built-in Intel CPU are rather extensive. We also see support for memory speed, voltage and timing adjustments, and getting 5600 MHz memory installed as standard instead of 4800 MHz stuff is an option with the NEO 17 as well, should you be so inclined to have that little boost right out of the box. The NEO 17 throws that to the wind and offers a plethora of user-adjustable performance options for the built-in CPU, ready for you to undervolt so it can scale further and offer optimized performance. Most laptops have rather constrained BIOSes, with little-to-no options that we as enthusiasts might be interested in. That is important because this version of the NEO 17 does strive even further to be like a desktop in what it offers, starting with the BIOS. Nahamic offers some nice user-adjustable presets as well as fine-tuning options if that is more to what you'd prefer, and while it might not seem like that big of a deal, anything that improves audio in the laptop space comes as a welcome addition since the size constraints here really affect audio performance compared to a desktop. I am personally a big fan of what Nahamic offers, and it has been around for many years now, and seen many updates. I'd hazard a guess and say that overall noise is reduced by half while gaming and using the OASIS, and that lets you run the speakers at lower levels, where they can be more accurate.įurther to the audio updates is a change from Creative's Sound Blaster audio software to Nahamic by Steelseries. ![]() it actually makes the NEO 17 run quieter while at full load, too. The whole OASIS experience is brand new, and I have to commend XMG for taking so much time and effort in updating this part of the NEO 17, as it takes what was great before and brings it up a level into something that is truly incredible. Noise levels are significantly reduced compared to the previous version, thanks to all these updates. Even the power cord is removable this time, where the past OASIS saw the power cord stuck out like a tail. I think the radiator might be the same, but that's about it. As if that wasn't enough, we have the quieter pump, and the new hose fittings too, so most of the physical water loop has seen an update. We also see a well-lit water-level indicator, something that truly needed an update. Updated pump and fan are present here, as is a fancy new magnetic quick connect, a little engineering marvel that makes connecting and disconnecting the OASIS unit from the NEO 17 truly quick and easy, without so much as a drop of water lost.Īlthough it has about the same size as the previous version, the new OASIS cooler features a grille that lets the fan peek through, and for good reason, as this time around we have a rather well-lit RGB fan providing airflow to the 120 mm rad. The highly functional OASIS watercooler is completely different this go around, with no aspect of it left untouched. From audio down to the keyboard everything has been given an update and so much so that I'm utterly impressed that I have so much to talk about.įirst, let's talk about the elephant in the room, which is the OASIS water cooling. What they have provided in the 2023 version of the mighty NEO 17 sees updates to nearly every aspect of the laptop, and meanwhile there were no compromises made with connectivity. For some, those changes would be enough of a update, but not for XMG. Same power use as the past 3080 ti, but far larger performance figures. This go around, for 2023, we've got an Intel CPU, the mighty 32-thread Intel Core i9-13900HX, mated with the RTX 4090 175 W GPU. The 2022 version featured an AMD processor, mated with a 175 W 3080 Ti. XMG's NEO 17 has appeared on these pages before. ![]() 1st Stop Meat Market & Deli, 912 Colonial Ave., 80.Pizza and Donuts! It is easy to conclude that "Happy Endings" is a story about bad writing, bad plots, and failed fiction. ![]() What does the ultimate goal of "Happy Endings" seem to be? As such, the repetitive nature of "Happy Endings" emphasizes the changeability of fiction and the artifice involved in writing an interesting story. This repetition, then, ultimately draws attention to the concept of the writing process, as a writer attempts to puzzle through what to do with certain characters. However, it quickly becomes clear that characters are not the same versions of themselves across the stories. Readers will notice that many words, phrases, and concepts are repeated across stories in "Happy Endings." This repetition initially fosters confusion, as it appears that each story is simply a different time in the characters' lives. Why does Atwood repeat characters' names and particular words and phrases in each of the stories? It is not the ending, then, that is important when crafting a good story. This repetition of characters' deaths connects to the narrator's concluding assertion that all stories actually have the same endings – characters die. John does not endure this and he decides to kill them. One day, John comes and finds Mary and James having sexual intercourse. Mary does not love John though, and instead loves James, who is often away riding his motorcycle. In scenario C, John and Madge are married but John and Mary are having an affair. When Mary realizes, she tries to commit suicide to attract the attention of John and make him confess his love for her but unfortunately, she dies. However, John does not take her love towards him seriously because he secretly has an affair with Madge. For instance, in scenario B, Mary is deeply in love with John. She portrays the characters in different scenarios having both good and bad endings. How does the theme of mortality manifest in "Happy Endings"?Ītwood depicts mortality as the ultimate end of every character regardless of leading a happy or bad relationship. |
